A Complaint for Contempt is an action to enforce the terms of an existing Judgment or Temporary Order of the Court. In order to prevail in a Contempt action, the moving party must prove that the defendant violated a clear and unequivocal order of the Court, and that such violation was knowing and willful.
The Court has the authority to award legal fees to be paid by the defendant to the moving party if the defendant is found in Contempt. A successful Contempt action requires attention to detail and organization of the evidence in order to prove each count of the Contempt.
